MNN. Feb. 9, 2015. On May 18, 1997, over 100 Haudenosaunne/Iroquois were brutally beaten by New York State Troopers. They disrupted a sacred tobacco burning ceremony at Onondaga, the capital of the Iroquois Confederacy. Lawyers, Terrance Hoffmann of Syracuse and Abramowitz, Grand, Iason & Anello of New York City, volunteered to act for us, free of charge. Since then the Troopers lost twice to have their case thrown out, purporting they were just carrying out orders in the line of duty.homeland

The Admiralty court was advised that if this case went to trial the Haudenosaunee would win. Judge George Lowe advised NYS to make a financial settlement with us. 13 plaintiffs refused the “cash and shut up” settlement. The case must now proceed to trial. In February 2014 the lawyers made a motion to drop those of us who did not agree with the settlement. This case was never about money. It’s about accountability and holding those responsible to account. Judge Wiley Dancks allowed the lawyers to drop us.  [Andrew Jones et al v. Parmley, et al Civil Action No. 98-CV-374 [FJS][TWD].

We are lawyerless and penniless. It seems this was part of their plan. We recently met in Onondaga and became of one mind. We will defend ourselves and ask for all the disclosures. We’ve been 18 years in the wildnerness of the US court system. It reminds us of Apache Chief Geronimo’s last stand in the wilderness of Mexico.

The United States District Court Northern District of New York may be doing an end around Article 7 of the Canandaigua Treaty which states:

“Lest the firm peace and friendship now established should be interrupted by the misconduct of individuals, the United States and the Six Nations agree, that for injuries done by individuals, on either side, no private revenge or retaliation shall take place; but, instead thereof, complaint shall be made by the party injured, to the other; by the Six Nations or any of them, to the President of the United States… as shall be necessary to preserve our peace and friendship unbroken, until the Legislature (or Great Council) of the United States shall make other equitable provision for that purpose”.

MNN. May 27, 2014. When the men are ready for battle with an enemy that refuses to accept the Great Peace which is the law of the land, they shall choose one of the War Chiefs to lead them into battle.

After a request for peace is made three times, and peace is not accepted, the War Chief shall drop a bunch of black shells and then quickly club the offending chief[s] to death. War shall be declared. War must continue until the Iroquois win.

When an enemy is defeated because it refuses to accept the Great Peace, all their rights, property and territory comes under the trusteeship of the Iroquois.

After the battle all weapons of war are taken from the enemy. The enemy shall observe all the rules of the law of the land, Kaianerekowa, for all time to come. Wampum 84.

The Wyandot [Huron] did not want to follow the Great Peace anymore. They chose war and allied with France. The last time the Mohawks dropped the black wampum was in 1645 on the errant Wyandot chiefs. They refused to grab the black wampum before it hit the ground. Iroquois invaded Ontario with 10,000 warriors. The Huron were in their own homeland with 30,000 warriors. By 1649 they were done. Mohawk defeated them in everyone of their communities in Ontario. They were driven out of Ontario in the east to Quebec and in the west to Wisconsin where they still reside to this day. We continued to fight the French until they sued for peace. The Great Peace of Montreal happened on June 25, 1701. The French never beat the Iroquois in any battle in the whole 92 year war.

May 14, 2014. Seventeen winters have passed since over 100 Iroquois women, children and men were viciously attacked by the New York State Troopers while we were conducting a thanksgiving ceremony. The issue is now before the Admiralty Court. The whole natural world awaits a return to the natural proper balance. As infamous Rob “12-step” Ford, the crack-smoking mayor of Toronto, advises on Indian matters, “It’s a real sensitive issue. I can’t step on any toes!” All front men for the shareholders of the “crown” corporation known as the United States of America have the main task of continuing the illusion of freedom to the people. Our lawyer, Terrance Hoffman, dumped those of us who would not take the money. The original Two Row Agreement and the treaties have been breached.

The Two Row Wampum [Guswentha] and the Canandaigua Treaty 1794 were the first treaties enacted by the United States of America after the Revolutionary War. It provides that when peace and friendship is interrupted between an Iroquois party, nation or the Confederacy, complaints shall be made to the President of the United States. He must act upon the matter to correct the impediment to peace that has been breached by any of his parties.

This case began on May 18, 1997. Over 160 New York State Troopers attacked us while we were conducting a thanksgiving ceremony at a private property on Onondaga Territory. Terrance Hoffmann Esq. of Syracuse and the lawyer for the other victims, Morvillo Abramowits of New York City, approached us and suggested suing New York State. We victims want those who plotted the plans, gave the orders to the police and the policemen who carried out the crimes to be punished. In 2008 NYS Judge George Lowe, after studying the evidence, reported that NYS would lose the case should it go to trial. He strongly advised NYS to settle with us for money. Some clients were coerced into taking the money. Mr. Hoffmann advised those who did not to find another lawyer or represent ourselves in this complex 17-year old case. He pressured us to take the money and let the criminals get away with their wrongdoing. We told him to keep the money. We want the criminals charged. On May 19, 2014, Mr. Hoffman will ask Judge Dancks to let him drop some of his clients.

Mr. President, this is one of the first treaties the US ever made. It is binding. The peace is threatened. You must make sure the wrong is made right. We don’t want a judicial remedy. We want a political remedy as prescribed in the Two Row Agreement and the treaties.

Cornwallis and Washington would meet every Thursday night in the Masonic Lodge to prearrange all the battles “fought” in 1776, 1777 and 1778. Both were 32nd degree Free Masons. It was all theatre to plan who was going to win or lose. Washington would start a musket volley, the British would return fire, 10 Americans and one or two British would be injured, then the Americans would run away and the British could never catch them. The rag tag fighters would have their shirts tied on their feet for boots, until apparently they got some money from Congress!

Until December 1778 the biggest army Washington could muster was 1,000 men. His first victory was December 17, 1778 against the Hessian mercenaries sent over by King George to lose to the Americans.  

In January 1779 General Sullivan amassed a troop of 13,000 men. In February 1779 he marched them with horses and cannons. They came at us with everything they had, through Seneca country, to attack the Iroquois capital at Onondaga. In the meantime, the British army parked their ships in Quebec City and took a year off. They let the Americans finish the dirty work on the Iroquois that Champlain started in 1609.   

The real reason for the American Revolutionary War was to attack the Iroquois and to divide and conquer the Indians by putting up a corporate border [a pretend line] through the center of our territory. We noticed right away the same families were running everything on both sides of the border.  

The Constitution of Peace was turned into the constitution of war. The Council of Women was replaced with the Senate [all men] and the consensus process was changed from one mind to 51%. The people could never again become of one mind on any issues. Any war will continue forever.

MNN. Aug. 28, 2013. In the spring of 2005 the women of Akwesasne asked the men to fill council positions in the Turtle, Wolf and Bear clans. Bear and Wolf Clans each selected three men and the Turtle Clan selected one. During the next few years, they worked on establishing various businesses to help the people. 

In July 2011 to September 2012 the Three Feathers casino in Akwesasne was operated by the Longhouse people.

At 5.00 a.m. on December 18, 2012 Three Feathers was raided by US federal marshals, border patrol agents and Mohawk tribal police. Rorahkwiserake of the Wolf Clan was arrested at the business site on a US warrant using NYS Inc. gambling laws that are invalid in Akwesasne. Three men were named in indictments. Kahnieretiio of the Bear Clan was placed under house arrest and could not leave Akwesasne. Tony Laughing was also placed under house arrest with an ankle bracelet. Bail [ransom] of $50,000 was set for Rorahkwiserake of the Wolf Clan who remains in a Plattsburgh NY prison. leg bracelet

On December 28 2012 the Six Nations Rotiskenrakehte/Men received the issue. Six Nations Counsel of Chiefs, Tekarihoken Royaner, offered his clan family support. Kanenhariyo, on formal loan from the Turtle Clan, became temporary Ayonwes [War Chief]. 

The Two Row Wampum agreement gave Europeans limited rights to live on our land. They are bound to return any of our people who may be in violation to be judged by our people. We must also return their prisoners to them. [Two Row Wampum, Great Law of Peace and Great Peace of Montreal 1701.] Ignorance of the law is  no excuse.

The Mohawk/Kanionkehaka are the northern “Keepers of the Eastern Door” of the Iroquois Confederacy. We are the enforcers of the Great Peace and protect our people, territory and waterways. The charges by the foreign corporations of the United States, New York State, US federal marshals, border patrols and Mohawk tribal police against our people are illegal. The St. Regis Mohawk Tribe Inc. is a foreign entity. The Kaianerekowa/Great Law of Peace is the only law of Onowaregeh. We never forfeited jurisdiction over ourselves, our land and resources to foreign entities incorporated under the Admiralty law of the seas. We have a rightful duty to resist. 

These principles are affirmed in the US Constitution, British North America Act; the international Covenant on Civil and Political Rights, the Universal Declaration of Human Rights, the Convention on the Prevention of Genocide, United Nations Convention on Economic, Social and Cultural Rights and other international legal instruments that the US and Canada have signed. 

General Assembly Resolution 1541 [XV] requires the informed consent of the people before they are included in another state; the international Court of Justice affirmed this in the Western Sahara case; and the Indigenous people never consented to be part of the US and Canada.  

All individual or foreign entities wishing to discuss issues with us must go through proper protocol, which is the US President and Queen Elizabeth, who represents the occupiers.    

This illegal interference in Indigenous trade and commerce will end. The Mohawks will resist illegality and affirm our inherent rights.akwe casino

NO JAIL TIME FOR KAHENTINETHA HORN

On January 21, 2011, Kahentinetha Horn pleaded guilty to charges of assaulting police officers and obstructing justice. The charges arose when the publisher and editor of Mohawk Nation News was attacked at the Akwesasne viagra-US border on June 14, 2008 by the Canada Border Services Agents CBSA.
Her lawyer, Phil Schneider, and the crown attorney at Cornwall Court agreed that if she pleaded guilty to the obstruction, the assault charge would be withdrawn. The judge gave her a sentence of an absolute discharge, with no criminal record.
Background: Kahentinetha had a problem that occurred at the border two and a half years ago on June 14, 2008. She drove to the Canada-US checkpoint on Cornwall Island with two Mohawks, a man and a woman. They were pulled over allegedly because the woman passenger had an outstanding arrest warrant.
An hour went by. Around 2:15 pm, “We were surrounded by about a dozen flak jacketed, steel toe booted, leather gloved and well armed special squad”, said Kahentinetha.
The male passenger got out and sat on the nearby bench. The customs officers spoke to her female passenger, who was reluctant to get out. The CBSA pulled her out, pushed her to the ground, handcuffed, subdued and took her away. Kahentinetha said, “I became afraid for my safety. They had no reason to stop me. When they asked me to get out of the car, I became scared after I saw what they did to her’.
The mob of guards swarmed to her side, ordering her to get out without giving a reason. She hesitated.
She told them, “I’ve done nothing wrong, have no outstanding charges, contraband, or reason to be questioned.”
After the treatment of the others who were under her protection, she wondered what they would do to the owner of the car? “I told one customs officer after another, “I refuse to be mistreated like my passengers”. They gave her no guarantees this was not going to happen to her or worse. She had no independent witnesses.
12 large male and 2 female customs officers swarmed around. “I saw big trouble for me if I got out’, said Kahentinetha.
At a signal from a guy taking orders by cell phone, they pounced on her, pulled her out and started twisting her left arm. The pain was so severe she thought they were breaking it. She screamed and tried to pull her arm away. [This is all on the Canada Customs video.]
She began to think they were after her, not her passenger. They obviously knew who she was. They kept calling their superiors and must have been told to take her out and arrest her, no matter what.
The question is why did they need so many large male guards to deal with a 68-year old woman? The had taken a long time to verify her age, address, background and car.
“I’ve been through this before with police officers who have tried to put me in hospital or a morgue. There seems to be a lot of anger towards me”.
They finally dragged her handcuffed behind her back into the customs house where she was out of sight. She was put alone in a cell and roughed up. One of the guards kept tightening the cuffs. He tried to bend her over and push her arm up to stop the blood from circulating into her arms and across her chest. It seemed like they knew what they were doing. “An officer stood in front of me and tried to pull my head down towards her crotch area. I found that very disgusting’. They both kept yelling at her to bend forward. This would have caused the blood to rush into her heart and kill her.
What really scared me was I could feel them trying to pull my pants down as I was being bent over. “At that moment I saw stars, became dizzy, starting panting and having pains in my shoulder and across my chest and back. I almost passed out”, said Kahentinetha. The guards had tasers, which is electric shock that can kill a person. “They thought they could get rid of me without using it”, Kahentinetha believed.
It was at that moment her brother, Taiotekane, a lawyer, and his son Kanatase appeared. Everybody backed off. They went to a room to talk privately. He realized she was having serious physical problems. Her eyes were becoming glazed, her face was flushed and she had a hard time breathing. He demanded she be taken immediately to the hospital.
Mohawk Constable Pyke contacted the emergency team from Hogansburg NY who rushed an ambulance. His sister, a paramedic, began to deal with Kahentinetha. Her quick work saved her life.
Doctors at Cornwall Community Hospital told her she had suffered a heart attack. Before this she never had problems with her heart or health. Her heart was damaged permanently. Since then she had to stop a lot of activities.
Kahentinetha realizes that every indigenous person who crosses the border could be subjected to this treatment. It looks like the CBSA have hired those who have no concern for the lives of travelers who cross the border.
The border guards deliberately misstated the facts. They knew kahentinetha’s true age. Yet they described her as being a “large strong 55 year old woman’, which is untrue. Such disinformation is sent out to keep the public uninformed. Don’t believe anything the CBSA says. Beware!

CANADA ACCIDENTALLY RECOGNIZES MOHAWK SOVEREIGNTY
MNN. Sept. 8, 2009. The colony of Canada has officially recognized our sovereignty on Great Turtle Island and has taken steps to abide by the Two Row Wampum agreement. Canada admits they have no jurisdiction over Indigenous people and territory.On June 14, 2008, two women were peacefully crossing the illegal checkpoint in the middle of Kawenoke Island of Akwesasne. The Canada Border Services Agency CBSA called in 12 burly well-armed colonial goons to viciously attack the two women. One elder almost died of a trauma induced heart attack and the other was severely beaten and held incommunicado.

The two women live in the Mohawk communities of Akwesasne and Kahnawake. They filed formal complaints with the RCMP, OPP, Mohawk Akwesasne Police and the CBSA to investigate. All refused. The women were treated like enemy combatants with no rights. We are being falsely labeled as insurgents, terrorists and global risks. This violates the Geneva Conventions 1949 which set the standards in international law for humanitarian treatment of civilians and the victims of conflict. [See notes at end]

The women are not Canadian citizens as the Mohawk Nation never relinquished our territorial independence. The two women took it to the Federal Court of Canada, FCA T-1309-08, to address the human rights abuses. Canada is supposed to live up to its commitments under international law to respect human rights of all.

The Crown issued orders respecting our sovereignty. On October 23, 2008, Prothonotary Mireille Tabib ordered the two women to pay for Canada’s costs by depositing $19,460.00 with the court plus all subsequent costs. The reason! They live in Akwesasne and Kahnawake and are not residents of Canada. An appeal was filed. On January 29, 2009 Judge Francois Lemieux issued the same order. On Feb. 26, 2009 another case was filed by one of the women, T-288-09. On April 7, 2009, the same order was made because she lives in Kahnawake, making her a non-resident of Canada.

The Two Row Wampum agreement separates the colonists from the true original Indigenous jurisdiction. The Crown must fulfill our request to investigate our complaints against their agents. The CBSA acted outside its territorial jurisdiction when it assaulted the two women and cannot demand security for their costs.

The CBSA can never return to Kawenoke Island, the real name of Cornwall Island, which they abandoned on May 31, 2009. The Mohawks refused to allow these foreigners to carry guns in the middle of our community. The old Customs House sits empty and belongs to the Mohawks. CBSA needs to get their junk out of there. When Alcatraz was abandoned, it returned automatically to the Indigenous people.

The colony of Canada removed the CBSA checkpoint from Kawenoke to the foot of the bridge in the city of Cornwall Ontario. Cornwall is part of the Mohawk North Shore claim. A CBSA supervisor stated to Mohawk elders that the former Kawenoke Customs had to be officially de-designated as a Canada port of entry. The new one sits on Akwesasne land. CBSA has to remove its port-a-potties out of Cornwall to parts unknown, maybe back to England. Phew!

Our territory extends all across this land.In requesting Mohawks to report to them when leaving Kawenoke, which they formerly treated as part of the colony of Canada, they are respecting our sovereignty. They actually have no business asking our people anything. We cannot allow them to interfere with our natural birthright and our right to travel freely about our homeland or entering our communities.

The colonial pirates that are attacking and confiscating our legitimate products on our rivers are also out of their jurisdiction. They have no right whatsoever to interfere with our trade and commerce anywhere. All waterways are our highways long before the coming of foreigners to this land to be freely traversed by us.

These Federal Court of Canada orders recognize that Indigenous people on Onowaregeh retain international sovereignty. The demand for money is meant to discourage us from seeking justice against these brutal carpetbaggers. They are telling us we have to buy justice from them. Canada has no problems to dish out millions to the band and tribal councils to illegitimately sell us out and fraudulently try to settle our land claims. It violates the International Covenant on Civil and Political Rights.

Our political position does not allow them to assault or murder us, prevent freedom of speech or violate our human rights. These organized criminal cartels have no right to extort money from us. Everything they do falls under every kind of genocide known to humankind.

The checkpoint had to be removed. The border had to be removed. What’s next?

Art. 27, Geneva Conventions: protected persons are entitled to respect for their persons, honor, family rights, religious convictions, manners and customs. They shall be treated humanely especially against violence or threats and insults. Women should especially be protected against indecent assault based on race, religion and political opinions.

MNN. July 5, 2009. No Canadian or US government officials are talking to us. The guards and workers in the two checkpoints in Akwesasne have abandoned their posts since June 1, 2009. We can come and go off the island to the north. We can go off to the south but can’t come back. Our ancestors invoked some basic principles for us to use in such times.The federally run prison on Alcatraz Island in San Franciso Bay had been abandoned in 1963. In 1964 a small group of Lakota attempted to take the Island to invoke a principle in the 1868 Treaty of Laramie. All surplus abandoned federal land automatically reverts to the Indigenous nations.

On November 20, 1969 Richard Oakes of Akwesasne lead Indigenous People onto Alcatraz Island and held it until 1971. It was to prove a basic point. This event changed the relationship between Indigenous and the US government. Up to then it was negotiation, compromise and legal remedies forced down our throats by the government.

The Alcatraz Proclamation was signed, “In the name of all Indians … we reclaim this island for our Indian Nations”. Other abandoned federal facilities were reclaimed afterwards.

The US government knowing this principle was furious that the Indigenous would have the audacity to invoke it. This act focused the entire world upon this basic law. The US government was put on the spot. It could no longer be hidden in the dusty archives of the Bureau of Indian Affairs basement. In 1971 Richard Oakes was assassinated.

The Mohawks of Akwesasne have always asserted our rights for the world to know. The current Cornwall Island event reveals the nature of the relationship between the Mohawks and the US and Canadian governments. The Canadian government knows we can assert our rights over the abandoned buildings in the community, the highway and bridges that go through our sovereign land.

We can invoke the Great Law of Peace which all Indigenous people adhere to. We are one people by covenant.

The checkpoints have been abandoned because we won’t let their guards carry guns. We have not been violent in any way.

According to the principle, the abandoned US border checkpoint at Akwesasne irrevocably reverts to the Mohawk Nation.

The Canadian Twilight Zone check point in the middle of Kawehnoke on Cornwall Island was abandoned and irrevocably reverts to the Mohawk Nation.

The two bridges and highways onto the island are closed/abandoned by the US and Canada. They irrevocably revert to the Mohawk Nation.

The RCMP and other foreign police who patrol the foot of the bridge in the city of Cornwall are trespassers. This is disputed Mohawk land. They must leave.

None of these structures cannot be torn down because they now irrevocably belong to the Mohawk Nation. You build anything on our land, it’s ours.

The US checkpoint and bridge are patrolled by US Border Security Field Operations and a Mohawk Policeman. US Border Security is trespassing and must leave.

We can traverse the whole community of Akwesasne as one entity without borders. It was illegally divided by the US, Canadian and British governments into five jurisdictions – Ontario, Quebec, New York State, US and Canada. They legislated two separate councils, tribal and band, to divide us with their imaginary boundary line.

The outsiders cannot establish the perimeter of our territory to limit us to small areas of our vast Haudenosaunee territory. It is our right to decide who will cross the two bridges and enter our community and our territories.

The Mohawk elders and people made the initial demand for no guns in the hands of foreigners in our midst. Both US and Canadian band and tribal councils stood together and made demands on behalf of the sovereign Mohawk people.

The Akwesasne people took the initiative. This is an Iroquois Confederacy issue. It affects all Ongwehonwe, our friends and allies at the Canada- US and US-Mexico borders which were never meant for us. The visitors cannot apply their line to us.

Rumors has it that US and Canada might build a new bridge several miles west of Akwesasne. This is part of Haudenosaunee Territory. They have to consult us and get our permission. They think they stole this land outright. Not so! Most people in the world know that Great Turtle Island is ours. They cannot show any evidence that they’ve legally acquired any of our land. International law was violated by the US and Canada when they made laws to claim our land and resources.

Arrangements to speak with us must be made through the Governor General and US President. Mike Mitchell, the tribal and band councils do not speak for us. Under the Great Law, they have don’t speak for the Iroquois Confederacy or Mohawk Nation. Anything they decide is not valid because they represent the foreign US and Canadian jurisdictions. Our people sit under the tent at the crossroads at Kawehnoke and patiently wait for them to come and make valid and legal arrangements with us.

MNN. July 4, 2009. According to Mike Mitchell, the new band councilor, we hope he doesn’t mean that the Indigenous give and the colonists take! He has announced a give-and-take style negotiation with Canada. The armed border guards want to come into Akwesasne in exchange for something. He suggests the Canada Border Services agents CBSA could give by taking some cultural sensitivity training. If they become sensitive to us, our laws and our rights, they will get off the island and never come back. The colony of Canada has no legal business manning their store in the middle of our community.The Canada and US ultimatum is that they are going to keep the two bridges onto Kawehnoke on Cornwall Island closed until we let them come in with guns. As a band councilor, Mitchell has been a longtime anti-Confederacy sovereignty advocate. He seems willing to compromise the Mohawk nation position.Mitchell wants to make it look like he settled our valid complaint and come out looking like the hero. Some of the human rights complaints will be settled, he said. He wants to make the economically dying cities of Cornwall Ontario and Massena New York happy.Any deal Mitchell makes will only apply to those 350 people who voted for him, who obviously support the colonial band council system and their goal to undermine us. They are trying to set a precedent for outsiders to patrol other Indigenous communities.

This is a nation-to-nation issue. Canada and US both know that this is a Rotino’shonni:onwe movement based on our sovereignty, which is supported by international law. A majority have to give our fully informed consent which we will never.

There is talk of putting a temporary Canadian customs on the Cornwall Ontario side at the foot of the Bridge. This hasn’t been brought to the Mohawks. At least the Canadian government recognizes they can’t put guns on the island in the middle of Kawehnoke.

Not mentioned is that this too is Mohawk territory which is under dispute. The Mohawks have given the message that we are not going to be intimidated. This is being acknowledged by the non-native community. They now know that we cannot be pushed around anymore.

We must give credit to Dooley Thompson, the former chief, and his supporters, for standing up for the people forcefully and eloquently. Hopefully Mike Mitchell learns from his predecessor that the non-natives can’t walk over us. We are in the right. We don’t want guns like the others. We have to take a stand and stay with it. The cutting off of traffic to Kawehnoke has allowed us to feel relieved from the years of intimidation. It’s a vacation from the abuse that has been going on for a long time.

The Mohawks message to the world is that tyranny has to be resisted. With the move towards global totalitarianism by the few elite thugs and their military goons, the Mohawks, our brothers, sisters, friends, allies and supporters are showing everybody how to defend themselves without using violence. Only the truth!
