INDIAN DETAIL: FROM ‘PRO BONO’ TO ‘PRO SE’

MNN. May 16, 2015. “Pro bono” are free lawyers. “Pro se” are those who represent themselves. The “INDIAN Detail” military attack on Rotinoshonni at Onondaga was eighteen years ago. The “pro bono” lawyers had a winning case. Instead they decided to negotiate a financial settlement to drop the charges. 16 victims out of 100 refused to take the money and wanted a trial. Judge Wylie Dancks allowed the lawyers to drop them as clients, “I let the lawyers drop those victims who refused to take New York State’s money because I follow the law”?? “Remember”, said the judge, “this is a really big case!”

On May 15th, 2015, only one “pro se” victim was invited to the private Syracuse court discussion on the forthcoming trial. The judge suggested this plaintiff not attend and would phone if something important came up. Only the lawyers for all parties would have been there to make decisions. The other lawyer-less plaintiffs heard rumors on Facebook and showed up. Throughout the judge reminded the victims that the money is there and the charges can still be dropped.

One “pro se” reiterated, “I want to talk about how my nation was attacked by a foreign entity, my father was murdered and my ceremony was trampled upon”.

The “pro se” group asked many questions. The judge laid out the rules of the game: “Look at my direction of April 4”, “You’ll have to read everything in those boxes of disclosures”. “Where’s the statement about Ronald Jones and his wife” [he was murdered shortly after the attack and his wife died]. “Why didn’t one victim not make a deposition” [she’s almost 100 years old, doesn’t speak English and can’t travel!], so the judge let her off. She ordered another lawyer to send more stuff like copies of all the videos of the attack. There’s a truckload on the two cases that NYS Troopers already lost. One “pro se” said, “You sent me disks and I don’t have a computer”. Wylie Dancks suggested, “Go to the library and use their computer”. The former “pro bono” lawyers have copies and transcripts, which the victims have to pay for. Now another box of stuff is being sent to each “pro se”.

The judge ordered, “I will not have Mohawk spoken in my court room!”. One plaintiff asked, “Who were the people responsible for what happened to us?” The judge said, “Read docket #149!”

'I firmly believe in the right to a speedy trial.'The judge continued: “By September 11th we’ll do this; by September 25 we’ll do that; we’ll make more discoveries; October 3 we’ll have some more motions; on Nov. 6th other documents can be added; after that we can talk to each other by phone or in court; by New years eve we could have a summary dismissal [she hopes]. Otherwise, jury trial starts in 2016 [which will go on for a year], unless something ‘extraordinary comes up’, [like we might be so hopelessly confused we’ll drop the charges.] The victims of the INDIAN DETAIL were treated to “American exceptionalism”. PRISONERS OF WAR PSYCHOSIS

MNN. MAY 6, 2015.  First Canada passed the Indian Act 1876 to declare us as non-persons and wards of the state.  This was to take control of our Indian Trust Funds. On October 25th 1924 the Indian Advancement Act was implemented by the colony of Canada as the 100-year plan to be rid of the “Indian problem”. Prisoners of war camps POW called “INDIAN reserves”, were set up across Canada by the War Department in 1924. Barbed wire fences, guards, passes and permission to leave and our children removed and placed in residential school death camps. Indian Affairs is run by the Department of Defense to this day. They are now in their 90th year of completing this genocide program.

“On May 28, 2014, the St. Regis Tribal Council Inc. SRMT announced that it has agreed to sell to New York State our long-standing claims to all original kanionkehaka [Mohawk] land for all time. SRMT is a Masonic New York State corporation illegally imposed upon the sovereign people of Akwesasne in 1892. They attend the Massena Lodge [their true longhouse]. This “trustee” system is meant to steal ongwehonwe territory and eradicate the Mohawk Nation.  It violates the convention on genocide.

kanionkehaka object to this colonial strategy derived from Papal Bulls that are illegal. NYS “Memorandum of Understanding” MOU eliminates our inherent title to 9.9 million acres. Such “federal trusts” are remnants of colonialism. The incorporated Tribe does not speak for any kanionkehaka/Mohawk except for those incorporated INDIANS who voted for them, like all governmental systems illegally imposed on us. The Tribe’s support from the Mohawk Council of Akwesasne Inc., created by the corporation of Canada, is also part of the colonial assimilation strategy.

The Tribe admitted that NYS officials dictated the “settlement”. NYS Governor Andrew Cuomo threatened that this was their last chance to get a benefit! The INDIANS will be starved into submission, another old colonial strategy. He warned that the notorious City of Sherrill v. Oneida Indian Nation Inc. US Supreme Court case, would be used to eradicate our claims. The threat forced the Tribe to agree to the NYS drafted contract. Their fear of penalties affected their judgment, forcing them to abandoned their “lawful” fiduciary responsibility towards the people. They agreed to allow NYS to remove the kanionkehaka birthright and impose alien laws on us and our territory.

The Tribe claims to have the authority to extinguish all kanionkehaka birthright for all time, without consulting all kanionkehaka. They claim to be successors to the fraudulent treaty of the Seven Nations of Canada, which it seeks to enforce upon the kanionkehaka! No documents, resolutions or affirmations from the Seven Nations were produced (Algonquins, Nippissings, Kahnawakeronon, Oswegatchie, Hurons of Lorette, Abanakis of Odanak and Kanesatake Mohawks). As a NYS corporation the Tribe cannot qualify the rights of this entity nor enter into national agreements.

The Tribe’s “MOU” will use US federal trust to try to undermine the sovereignty, jurisdiction and land title of the kanionkehaka. There are no “benefits”. NYS will start collecting taxes from us and steal our land. This issue must go to a proper international court of dispute resolution such as the International Court of Arbitration in The Hague, a non-Admiralty court, designed to deal with this exact situation.

Tribal Trustee, Beverly Cook, at a Wolf Clan meeting on March 21/2015 urged us to bend to New York’s threats or “receive nothing”. She suggested the kanionkehaka start a separate claim using aboriginal title as a defense. All US courts are Admiralty, only for banks, corporations and contracts. Five people met with Mike Delisle of the Mohawk Council of Kahnawake Inc. [MCK Inc.] to affirm Kaia’nereh:kowa and Teio’hateh [Guswentha]. We objected to the attempted uprooting of all Kanion’ke:haka interests by selling the tract known as the “Seigneury” to the Corporation of Canada. Teio’ha:teh [Two Row Agreement] is the colonial settlers’ passport to live here in peace with us on our land.

WHEREAS:

1.The Great Peace affirms that our land and line of descent are vested in the women.

2.MCK Inc. are INDIANS, not Ongwe’hon:weh. They act for the CROWN and are overseen by the Privy Council. Those who accept a foreign process alienate themselves. MCK Inc. has no authority to discuss land with our oppressors. They have forfeited their Ongwe’hon:weh birthright, name, clan, voice and right to live among us. Their actions constitute espionage, conspiracy and complicity in genocide.

3.The US genocide model is to remove our ties to each other and to our land. Kahnawake is to be made unlivable through pipelines, highways, canals and railroads to transport stolen resources from the West.

4.Our land belongs to the faces beneath the earth. Kahnawake is part of the vast unceded territory of Ono’ware:geh [Great Turtle Island]. Parliament, the Queen, corporations, bankers and their followers are all foreigners.

5.Small private meetings are being held to falsely represent the consent of the majority. Such meetings as December 2, 2014 at the Golden Agers of 26 people are meant to finalize the murder of over 100 million Ongwe:hon:weh and the theft of hundreds of trillions from our trust funds. They win when we Kanion’ke:haka put a dollar value on our land. This allows Obama to trade Ono’ware:geh for the US bankers’ debt to China. Read: Obama: Ongwe’hon:weh land to pay debt to China We owe China nothing. Any interference with our title must answer to all 49 families, our friends and allies throughout Ono’ware:geh. Take the money for yourself and your family.” With the band council proposal to give us money for Kahnawake and the Mohawk interest in the Seigneury, and remove us away from the route of the pipeline, they appear to have bought into the economic hit man program.

The Mohawk Council of Kahnawake are using the traditional economic hit man approach on us – Bribe us. If we don’t take the money, then bring in the military. They had a meeting with us to say they had a meeting. Now they think they can sign away our land and remove us. The hit men’s job is to remove the final impediments to the CROWN’s theft . Those who don’t fit in have already been driven out.
