THREE FEATHERS

MNN. Aug. 28, 2013. In the spring of 2005 the women of Akwesasne asked the men to fill council positions in the Turtle, Wolf and Bear clans. Bear and Wolf Clans each selected three men and the Turtle Clan selected one. During the next few years, they worked on establishing various businesses to help the people. 

In July 2011 to September 2012 the Three Feathers casino in Akwesasne was operated by the Longhouse people.

At 5.00 a.m. on December 18, 2012 Three Feathers was raided by US federal marshals, border patrol agents and Mohawk tribal police. Rorahkwiserake of the Wolf Clan was arrested at the business site on a US warrant using NYS Inc. gambling laws that are invalid in Akwesasne. Three men were named in indictments. Kahnieretiio of the Bear Clan was placed under house arrest and could not leave Akwesasne. Tony Laughing was also placed under house arrest with an ankle bracelet. Bail [ransom] of $50,000 was set for Rorahkwiserake of the Wolf Clan who remains in a Plattsburgh NY prison. leg bracelet

On December 28 2012 the Six Nations Rotiskenrakehte/Men received the issue. Six Nations Counsel of Chiefs, Tekarihoken Royaner, offered his clan family support. Kanenhariyo, on formal loan from the Turtle Clan, became temporary Ayonwes [War Chief]. 

The Two Row Wampum agreement gave Europeans limited rights to live on our land. They are bound to return any of our people who may be in violation to be judged by our people. We must also return their prisoners to them. [Two Row Wampum, Great Law of Peace and Great Peace of Montreal 1701.] Ignorance of the law is  no excuse.

The Mohawk/Kanionkehaka are the northern “Keepers of the Eastern Door” of the Iroquois Confederacy. We are the enforcers of the Great Peace and protect our people, territory and waterways. The charges by the foreign corporations of the United States, New York State, US federal marshals, border patrols and Mohawk tribal police against our people are illegal. The St. Regis Mohawk Tribe Inc. is a foreign entity. The Kaianerekowa/Great Law of Peace is the only law of Onowaregeh. We never forfeited jurisdiction over ourselves, our land and resources to foreign entities incorporated under the Admiralty law of the seas. We have a rightful duty to resist. 

These principles are affirmed in the US Constitution, British North America Act; the international Covenant on Civil and Political Rights, the Universal Declaration of Human Rights, the Convention on the Prevention of Genocide, United Nations Convention on Economic, Social and Cultural Rights and other international legal instruments that the US and Canada have signed. 

General Assembly Resolution 1541 [XV] requires the informed consent of the people before they are included in another state; the international Court of Justice affirmed this in the Western Sahara case; and the Indigenous people never consented to be part of the US and Canada.  

All individual or foreign entities wishing to discuss issues with us must go through proper protocol, which is the US President and Queen Elizabeth, who represents the occupiers.    

This illegal interference in Indigenous trade and commerce will end. The Mohawks will resist illegality and affirm our inherent rights.akwe casino

MNN. JULY 29, 2013. What would you do if an old man sent pictures of his erect penis to your adolescent daughter, along with suggestive sexual invitations to have sex? It’s like suggesting a father rape his daughter. Former Congressman, Anthony Weiner, a wealthy politician running for mayor of New York City is setting this example. Former NYS Governor Eliot Spitzer, another old man, was caught soliciting a 22-year old. He resigned and became a media star. Both committed crimes against women. images-2

The rulers are dismantling US and Canada legally, socially, politically, commercially and ethically. Canada is being handed over to the US empire. Prime Minister Harper is taking apart everything so international bankers can access the resources.    

Inbred royalty is being displayed up front, the Royal Air Force and Queenie is pictured everywhere. Charles and Camilla may be installed as king and queen of Canada. The working class continues to serve as the resource extractors.   

Anthony Weiner is a litmus test of a dying empire, of parasites that steal everything and produce nothing, of openly scamming everyone, and of a decaying rotting society. Thousands of years of ethics, decent norms and intelligence is being trampled upon. Sexual voyeurism attacks women and children first, followed by the massacre of humanity. 

Both Spitzer and Weiner’s wives stood by their man. They forgave their husbands because they don’t care about other people. Vanity, status and being a mayor’s or CEO’s wife is more important. They are part of the problem and just as guilty. Guilt and corruption start internally. The collaborators are shielded. Society without morals becomes uncaring about politics. Weiner tells us, “I can be as decadent as I want”.  

The rulers have promoted the penis and pornography to represent power, war and status. This decadent strata of society must be removed from the human race or we will all go down. This should be the last exploiting class to rule. 

In the old way, men pursued the perpetrator, snapped him up, tied him to a tree and castrated him. The women whip him with a red willow in front of the people.  Everybody has a choice. Our communities have the responsibility to take care of our women and children. The masses rely on their police, politicians and congressmen, many of whom are committing indecencies. If people don’t confront Weiner, they agree with it.

Now other sickos can approach and attack young girls who refuse their advances. Our girls and boys must resist even if their parents are too busy in a system that makes these young girls vulnerable. A sting operation is going on in 74 US cities for child prostitution.

CRIME DESIGN

MNN. June 30, 2013.  In 2005 the RCMP published a “ground-breaking” analysis on, “Aboriginal Organized Crime in Canada”. [43 pages]. Academics E. J. Dickson Gilmore and Chris Whitehead of Carleton University Ottawa were the fiction writers. Using classic fake racial profiling and character assassination, they gave the RCMP labels to criminalize all aspects of Indigenous life.

According to modern international law, the Charter of Rights and Freedom and the US Constitution, “There can be no crime without a law”. Everyone is entitled to a fair and public trial. To get around this Gilmore made up a new definition of organized crime: “An ongoing activity motivated by political, social and/or economic conditions [or some combination thereof], .. articulated through formal and informal cooperative social relationships with the potential for corruption an/or violence to facilitate the criminal process.” [page 13]. www.rcmp-grc.gc.ca/ccaps/research_eval_e.htm 

If that’s the case, all corporate government like Canada and US are “motivated by political, social and economic ends”; have “a network of both formal and informal cooperative social relationships”; and “have a potential for corruption and/or violence”. 

She invented four “Aboriginal organized criminal types”: 

1.”Activist/Nationalists” who join an organization to express their culture, history or rights. Canadian and US culture is based on extortion of funds from the people by Revenue Canada and the IRS.  global org crime

2.”Random/Opportunists” are less sophisticated and expendable, motivated by peer pressure. 

3.”Activist/Opportunists” start as Nationalist/Activists who try to become selfish like Stephen Harper and Barack Obama. 

4.”Criminal/Opportunists” are motivated by profit, like the multi-national mega corporations that are gulping our resources and ever growing $135 trillion Indian Trust Fund by enforcing illegal corporate by-laws. 

A strong connection exists between criminality and colonial governments. Illegal corporate by-laws are imposed on us, using genocide, murder, violence, corruption and lies. They are unconcerned about the massacre of the buffalo, starvation of the people, incarceration, kidnapping, killing and raping our children in residential school death camps. They complain we primitive people have a hard time adjusting to cities. 

Well-paid shills, Gilmore and Whitehead, provided no clear evidence of “Aboriginal organized crime” in Canada. Probabilities, assumptions and innuendo are outlined. Our nations are being systematically defamed for the career advancement and salaries of cops and their academic accomplices.ideologues

Bilderberg Association is a registered UK charity that takes “donations” from BP, Goldman Sachs and other multinational corporations. They plan to control the world, i.e. (the price of oil for everyone, who is the next victim in the war program, etc.).  Attending are the IMF, European Commission officials, a dozen other heads of corporate states, transnational CEOs, international bank bosses, corporate media owners, BP, Google and Amazon. Media is invited so they will not report on anything they are doing. UN institutions like the World Bank, World Trade Organization and politicians from the US, Canada, the UK and the EU are always there.

MNN. Apr 30, 2013. Federal Court of Canada was asked: Does Canada have a constitution? Are Sections 109 and 132 still part of the British North America Act 1867? If so, our rights to our lands, resources, funds and our sovereignty supersede that of Canada. [Thahoketoteh of Kanekota v. the Queen, T2007-13, Apr. 8, 2013].  Judge Snider refused to answer this simple question, in 4 pages of nonsense. She ordered Thahoketoteh pay $500 for the tele-conference trial, which cost $0. The corporate court system is set up to encircle, subvert and overthrow anyone going against the Corporation of Canada. rule of law

Kanekota was a direct confrontation in their own arena, by their own rule of law, which they did not follow. They sit in judgment as one of the parties in the dispute. This violates international law against genocide. Canada could only deny us our basic human rights.  

Canada has a constitution which the courts do not have to follow because it was not ratified by the people. At the signing of the 1948 UN Declaration on Human Rights, Canada and US signed. A clause was added exempting US and Canada from the International Criminal Court. They could never be tried for any human rights violations. They can only be tried domestically. Accordingly, they are waging war everywhere in the world.   

Their blatant disregard for the questions indicates their uncertain future. With their accomplices, the UN, IMF, World Bank, BIS and other Rothschild owned banks, they are fighting the advancing consciousness of the people who live with the land. junta

We are a free people with free minds. Their fake system needs our resources and our labor. They are trying to break us up into moderate and militant blocks to fight or negotiate with one side or the other. The world balance is shifting. Rather than encircling us, they are being encircled. To start WWIII they need to steal our resources, funds and labor.   

Many supported our case to help promote our constitution of peace. Judge Snider’s “fatally flawed” decision opened the eyes of all, that going into their theater of the absurd is a waste of time.   

Thahoketoteh felt that the energy of putting his mind into the case was anti-spiritual. They will never rule against the corporation. Nor allow a third party adjudicator to make it a fair hearing. We are living in a military dictatorship with no rule of law. Our true constitution for thousands of year is the law of this land. CANADA’S SNOW JOB

MNN. Apr. 27, 2013. James Anaya, the special UN rapporteur on the rights of Indigenous peoples, says the Harper government until recently refused his request to investigate the “human rights situation of Indigenous peoples”. He was refused official entry into Canada. The violations were so serious that he was ready to meet through unofficial channels. He was finally given a permit, with conditions?feudalism

Canada’s national human rights commission is getting flooded with complaints from Indigenous about the discrimination and misconduct of their corporate Indian band councils for selling out our resources to Harper’s multinational banking buddies. Harper is telling us to go to the very agents we are complaining about. Harper’s job is to shut us up and speed up the rape of our resources.

The number of complaints has grown by over 1000% annually since 2008 on issues such as land and resource theft, denial of housing and decent living conditions, voting eligibility in band council elections, shortages of federal funding for child welfare, education and policing. Harper refuses to pass along some of our ever-growing $70.1 trillion Indian Trust Fund to help alleviate third world living conditions.

Harper created a special system within the human right commission so that we can’t take our complaints directly to the commission. We have to take it to the band council we are complaining about. Similar to the RCMP rape victims told by Harper to take it to the RCMP for investigation. “When you have complaints about my discrimination and mistreatment of you, you have to go to my corporate Indian council rather than to the commission. You know, the way Duncan Campbell Scott of Indian Affairs set it up in 1924”.

Harper considers us less than human according to their colonial laws that are still in place. Former Prime Minister Paul Martin admitted on April 26 2013 at the federal Truth and Reconciliation Commission that the residential school death camps “engaged in cultural genocide”. Genocide is genocide, Mr. Martin, anywhere in the world. As former Prime Minister you are complicit in the cover up.

Harper did not want the special UN rapporteur to visit Canada. Anaya would have no choice but to the report to the world body the genocide  and human rights violation. FATALLY FLAWED DECISION

MNN. APR. 9, 2013. In Thahoketoteh of Kanekota and the Queen, T2007-12, the decision went against the constitution and “the rule of law”. Federal and provincial laws are applied to Six Nations by violating constitutional law, such as the Royal Proclamation being superseded by Corporation of Canada statutes. Canada is not a constitutional democracy as s. 109 of the British North America Act 1867 is being deliberately ignored. No legal reasons were given other than that Thahoketoteh did not state strong enough facts, for them to hear the issue.

In 2004 Thahoketoteh carefully chose an empty property in Kanekota, Lot 1 Concession 11, Clearview Township. Jim Flaherty, Minister of Finance, illegally claimed it, through a numbered company, probably with off-shore ties. He built a sprawling estate on it. Thahoketoteh pleaded  constitutional injury  headed by a minister of the government? What could be stronger than that?

Judge Snider ignored Thahoketoteh’s sufficient evidence of residency and Mohawk-ness. She accused him several times of being “fatally flawed”!  

The court ruled the existence of a trust relationship between Kanionkehaka/Mohawk Nation and the crown, which has been breached.

The Royal Proclamation is merely a royal prerogative that may be illegally displaced by a subordinate admiralty statute, violating their constitution. The proclamation was revoked by the subordinate Quebec Act 1774 UK, as it relates to the government and administration of justice in Quebec and Southern Ontario. Their written and oral arguments did not prove this. Our land remains unsurrendered and cannot be taken without our knowledge or consent. 

The court ruled that, “The Royal Proclamation cannot preclude the application of federal and provincial law”. Constitutional law does not have to be followed, if it doesn’t suit the corporation’s interest. Canada is a pretend democracy with no real constitution. 

“The Royal Proclamation was revoked and cannot override federal and provincial law” at Kanekota, that Thahoketoteh’s interest made “the proclamation irrelevant”. The 1784 Royal Proclamation protects the Mohawk from encroachment forever.  

In principle Canada must provide peace and protection to the Mohawk of Kanekota. The court said that this dispute resolution mechanism crafted over three hundred years ago [Mohegan 1704] does not apply to disputes between First Nations and the Crown.  According to the 1932 Westminster Act Canada was supposed to create a constitution ratified by the people. This never happened. Canada remains a colonial corporation, without a constitution or Bill of Rights.

The court respects our arguments, then says, “Even if it did, s. 109 and s. 129 of the Constitution Act 1867 would not preserve this right of protection. Any appeal to the British Privy Council created by the 1704 Order in Council was abolished in 1949 by the Supreme Court Act. The Supreme Court has given itself exclusive ultimate appellate civil and criminal jurisdiction within and for Canada”, in their Admiralty court system. 

As Thahoketoteh explained to Captain Brown of the British Military, all courts in Canada are Admiralty ”law of the seas” courts. They claim jurisdiction of 250 miles from the coast and all inland waterways, except the water under the Grand River. The British military will protect this water for “us and our posterity forever”, as they are under military order to do so. Indigenous law has been violated since the fake war of 1776 and 1812. Military rule remains in place. General Sir Peter Wall, Chief of General Staff of the British Army is put on notice to enforce a standing Order left by the highest ranking general in the history of the British military. He must come and physically retake Kanekota. 

The court struck down Thahoketoteh’s action and he was ordered to pay $500 court costs. He will appeal. This carefully crafted decision to evade the rule of law means we are right. The court is following along the same old path and and avoiding the elephant in the living room,   breaking the rule of law. As the Bangles spin, “They are now walking like an Egyptian

THE TRIAL OF KANEKOTA

MNN. Mar. 19, 2013. The trial of Kanekota is at 9:30 a.m. Monday, March 25, 2013.  

On July 18, 2012, Thahoketoteh of Kanekota filed action T-1396-12 against the Queen in the Federal Court of Canada. Kanekota is a 575 square miles area in the north of the Grand River. This is the northern part of the Grand River land protected by the Royal Proclamation 1784, for the Mohawk “them and their posterity forever” without encroachment.

Royal proclamations supersede all Admiralty Statues. All Canadian laws and courts are subject to existing royal proclamations. Thahoketoteh contends that Crown agents who ignore a royal proclamation are guilty of high treason. He asked that all stolen farms from the “mega quarry” application be returned to the Mohawk people; all settlers legalize their presence in Kanekota; and all squatters who do not want to legalize themselves be removed at Canada’s expense. Thahoketoteh filed a new action,T-2007-12, asking a constitutional question. He claimed that Canada is under a “legal duty” type of “trust” within the meaning of Section 109, Constitution Act 1867, not to apply or permit the application of federal or provincial law to the Grand River or Haldimand Tract, except by treaty, in compliance with the Royal Proclamation 1763 and proven, in the event of dispute, before the Standing Royal Committee constituted by the Order-in-Council [UK 1704]. 

The oral portion of the trial will be through teleconferencing, which will eventually be available on Mohawk Nation News. Everyone can read the entire case on mightisnotright.org.  Thahoketoteh is representing himself. He expects the judiciary to follow their own law. 

Sec. 109 of the Constitution Act 1867: All Lands, Mines, Minerals, and Royalties belonging to the several Provinces of Canada, Nova Scotia, and New Brunswick at the Union, and all Sums then due or payable for such Lands, Mines, Minerals, or Royalties, shall belong to the several Provinces of Ontario, Quebec, Nova Scotia, and New Brunswick in which the same are situate or arise, subject to any Trusts existing in respect thereof, and to any Interest other than that of the Province in the same.”

Federal Court: “What elephant? I don’t see it!”

This section 109 is like the elephant in the living room that the judiciary pretends is not there. It affirms the Indian Trust Funds that MNN keeps mentioning.  

Since the trial will not be available to the public we suggest people go to trial of Kanekota to read the written argument. 

Canada is the defendant in this case. We are reminded of the Stones song; Hand of Fate: “I’m on the run. I hear the hounds. My luck is up. My chips are down. So good-bye, baby, so long now.
